Your estimated end of service benefit

An estimate based on Articles 51 and 53 of Kuwait Labour Law No. 6 of 2010. Your employer's final settlement may differ, for example if your contract gives more, if allowances are counted differently, or if you work in government or a free zone with its own rules.

How indemnity is calculated in Kuwait

Article 51 of Labour Law No. 6 of 2010 gives monthly-paid workers in the private sector an end of service indemnity of:

  • 15 days’ pay for each of the first five years
  • One month’s pay for each year after five years
  • Part of a year counted pro rata
  • A maximum of 18 months’ pay (one and a half years)

One day’s pay is the monthly salary divided by 26, the method Kuwaiti courts use. Workers paid by the day, week or hour get 10 days a year for the first five years and 15 days after, capped at one year’s pay; this calculator is for monthly-paid workers.

What happens if you resign

Under Article 53, a worker on an open-ended contract who resigns gets:

  • Less than 3 years: no indemnity
  • 3 to 5 years: half
  • 5 to 10 years: two thirds
  • 10 years or more: the full indemnity

These cuts don’t apply to fixed-term contracts, or when the employer ends the contract. A female worker who resigns within a year of her marriage gets the full indemnity.

Worked example

Sameer earns KWD 800 a month and leaves after 8 years. His daily pay is 800 ÷ 26 = KWD 30.769.

  • First 5 years: 5 × 15 × 30.769 = KWD 2,307.692
  • Next 3 years: 3 × KWD 800 = KWD 2,400
  • Full indemnity: KWD 4,707.692. If he resigned from an open-ended contract, he would get two thirds: KWD 3,138.462

Frequently asked questions

How much indemnity will I get after 5 years in Kuwait?

75 days’ pay: 15 days for each of the 5 years, at the monthly salary divided by 26. On KWD 800 a month that is about KWD 2,308. If you resign from an open-ended contract between 5 and 10 years, you get two thirds.

Is there a maximum indemnity in Kuwait?

Yes. For monthly-paid workers the indemnity can’t be more than 18 months’ pay.

Do I get indemnity if I resign before 3 years?

Not on an open-ended contract: a worker who resigns with less than 3 years of service gets no indemnity. On a fixed-term contract the resignation cuts don’t apply.

Can my employer deduct social security from my indemnity?

No. For Kuwaiti employees, the employer can’t deduct its PIFSS contributions from the indemnity.

Is indemnity based on basic or full salary?

Most employers use the basic salary, but the law refers to the worker’s pay, and courts can include regular allowances. Check your contract and payslips.
