How gratuity is calculated in Oman
Under Article 61 of Royal Decree 53/2023, the Oman Labour Law, non-Omani employees in the private sector are entitled to an end of service gratuity of:
- One month’s basic wage for each year of service
- Part of a year counted pro rata
- Worked out on the last basic wage, without allowances
Before the new law took effect on 31 July 2023, the rate was 15 days’ wage a year for the first three years and a month a year after that. Some employers still apply the old rate to service before that date; tick the box in the calculator to see that figure.
Worked example
Ravi’s last basic salary is OMR 500 a month and he has worked for 6 years.
- 6 years × one month × OMR 500 = OMR 3,000
Does resigning reduce gratuity in Oman?
No. The gratuity is the same whether you resign or your employer ends the contract. It can be withheld only if you are dismissed without notice for one of the serious reasons in Article 40.
The savings system that will replace gratuity
Oman is moving expatriate end of service benefits to a savings system run by the Social Protection Fund, with employers paying 9% of the basic wage each month. The Fund’s board sets the start date. Gratuity you have already earned before that date is still owed by your employer.
